Welcome to Karmika, a mobile application and web platform owned and operated by RASA MARCON PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 with its registered office at D5, Jai Ganesh Vision, Akurdi, Pune – 411035, Maharashtra (“Karmika”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of the Karmika platform as a Work Seeker.
By registering and using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not accept these Terms, you should not access or use the Platform.
1. Definitions
- “Work Seeker” or “you”: Any individual registering on the Platform to offer services for hire.
- “Work Provider”: Any business, employer, or registered client seeking workers through the Platform.
- “Platform”: The Karmika mobile app and website, through which users can connect and engage with one another for work-related purposes.
- “Engagement”: Any job or work assignment accepted or executed through the Platform.
2. Acceptance of Terms
By using the Platform:
- You confirm that you are at least 18 years of age and legally capable of working in India;
- You agree to comply with these Terms, the Privacy Policy, and all applicable laws;
- You acknowledge that your engagement with a Work Provider is independent of Karmika.
3. Modifications to Terms
Karmika may revise these Terms at any time. Updates will be posted on the Platform, and your continued use after such changes constitutes your agreement to the revised Terms. You are advised to review these Terms periodically.
4. Registration and Account
(a) Eligibility
- You must be at least 18 years old and legally entitled to work in India.
(b) Account Information
- You agree to provide accurate, current, and complete personal information during registration. False or misleading information may lead to account suspension.
(c) Account Security
- You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
(d) Termination
- We reserve the right to terminate your account at our sole discretion for breach of these Terms, non-compliance with law, or misconduct.
5. Nature of Platform and Relationship
Karmika is a facilitator platform only.We do not employ, manage, or control Work Seekers or Work Providers. You acknowledge that:
- You are an independent service provider, not an employee of Karmika;
- Your engagement is directly with the Work Provider;
- Karmika is not liable for the nature, duration, compensation, or outcome of any job you accept through the Platform.
6. Conduct and Responsibilities
You agree to:
- Provide services honestly, responsibly, and to the best of your ability;
- Not misrepresent your identity, qualifications, or experience;
- Comply with all job-related safety instructions, labour rules, and legal regulations;
- Refrain from theft, violence, abuse, intoxication, or harassment while on duty.
Violation of any of the above may lead to immediate termination of your account and blacklisting from the Platform.
7. Subscription and Fees
To access job opportunities, you may be required to pay a daily subscription fee.
- The applicable subscription pricing will be displayed on the Platformat the time of payment;
- Subscription fees are non-refundable, regardless of job acceptance or placement;
- Karmika may modify pricing at its sole discretion, with or without prior notice.
8. Payments and Taxation
(a) Payment of Wages
- All payments for services rendered must be made directly by the Work Provider. Karmika is not responsible for salary, wages, or reimbursements.
(b) Tax Responsibility
- You are solely responsible for your tax liabilities including income tax, GST, or any applicable levies. Karmika does not withhold or file taxes on your behalf.
9. Disclaimer on Compensation and Liability
You expressly agree and acknowledge the following:
- is not responsible for any payment or non-payment of salary, daily wages, or promised compensation by a Work Provider.
- All such obligations lie solely and entirely with the Work Provider who engages your services.
- In case of any delay, underpayment, denial of salary, or dispute over job-related compensation:
- You agree that Karmika and RASA MARCON PRIVATE LIMITED shall not be held liable under any circumstance;
- You shall any legal or administrative remedy directly against the Work Provider;
- Karmika shall not participate in mediation, dispute resolution, or enforcement of any employment agreement.
- Karmika does not guarantee:
- That you will be selected for any job;
- The duration or continuity of any assignment;
- Any statutory benefits like Provident Fund, ESI, bonus, gratuity, etc.
- You waive and release Karmika and its directors, officers, and staff from any legal claims arising from:
- Non-payment of wages;
- Job termination or contract breach by the Work Provider;
- Unsafe working conditions or unfair treatment.
10. Confidentiality
You agree to treat all non-public information about the Work Provider, their operations, clients, or business as confidential, and not disclose or misuse it under any circumstance.
11. Intellectual Property
All logos, software, content, user interfaces, and marks on the Platform are proprietary to RASA MARCON PRIVATE LIMITED.. You may not copy, modify, reverse-engineer, or distribute any part of the Platform or its code.
12. Indemnification
You agree to indemnify and hold harmless Karmika and its affiliates from and against any losses, claims, damages, penalties, or legal costs arising from:
- Your violation of these Terms;
- Any fraud, misconduct, or unlawful act committed by you;
- Any claim made by a Work Provider or third party due to your conduct.
13. Limitation of Liability
To the maximum extent permitted under law, Karmika shall not be liable for:
- Lost earnings or lost job opportunities;
- Delays in job matching or communication failures;
- Platform downtime or service interruptions;
- Any damages resulting from your engagement with a Work Provider.
Total liability, if any, shall not exceed the subscription amount paid by you in the last 30 days.
14. Termination
Karmika reserves the right to suspend or terminate your account:
- For breach of these Terms;
- Based on complaints from Work Providers;
- Due to fraudulent behavior or unsafe conduct;
- Or in cases where your continued access poses legal or reputational risk.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra. At our discretion, any dispute may also be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, and the venue shall be Pune.
16. General Provisions
- Agreement: These Terms constitute the full agreement between you and Karmika.
- No Waiver: Any failure to enforce a right shall not constitute a waiver of future rights.
- Severability: If any part of these Terms is invalid, the rest shall remain enforceable.
- Force Majeure: We are not liable for delays or failures due to events beyond our control.
- Assignment: You may not assign your account or rights to others without prior consent.

For Work Providers
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Work Provider”, “you”, or “your”) and RASA MARCON PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 and having its registered office at D5, Jai Ganesh Vision, Akurdi, Pune – 411035, Maharashtra (“Company”, “Karmika”, “we”, “us”, or “our”), governing your access to and use of the Karmika platform (mobile application and/or website) (“Platform”) for sourcing and engaging Work Seekers. By registering and using the Platform, you affirm that you have read, understood, and accepted these Terms in full. If you do not agree to these Terms, you are advised not to access or use the Platform.
1. Definitions
- “Work Provider”: Any business entity, organization, or individual that registers on the Platform to access, communicate with, or engage Work Seekers.
- “Work Seeker”: Any individual who lists their availability or offers their services through the Platform.
- “Platform”: The Karmika mobile application and website that facilitates interaction between Work Providers and Work Seekers.
- “Subscription Services”: Paid access to Platform features including worker discovery, job posting, and messaging.
2. Eligibility and Registration
- (a) Eligibility: You must be a legally competent person, duly authorized to represent your business, and capable of entering into binding contracts under applicable Indian laws.
- (b) Account Creation: You must submit accurate and complete information during registration. Karmika reserves the right to request and verify supporting documents, including PAN, GSTIN, incorporation certificates, etc.
- (c) Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and all activities conducted through your account.
- (d) Termination: We reserve the right to suspend or terminate your access to the Platform without prior notice in the event of any violation of these Terms or applicable laws.
3. Use of the Platform
You agree to use the Platform solely for lawful purposes and to engage Work Seekers for genuine and legally permitted jobs or services. You shall not:
- Misrepresent job roles, remuneration, or working conditions;
- Attempt to bypass the Platform’s subscription mechanisms;
- Misuse personal data of Work Seekers or harvest data for external use;
- Engage in conduct that is abusive, discriminatory, or exploitative.
Karmika reserves the right to monitor activity and suspend access in case of violations.
3A. Prohibited Job Postings
You undertake not to post or solicit any job or service through the Platform that:
- Is prohibited under any Indian law or government regulation;
- Involves child labor, bonded labor, trafficking, unlicensed security services, sex work, or any other unlawful engagement;
- Violates provisions of the Child Labour (Prohibition and Regulation) Act, 1986, the Bonded Labour System (Abolition) Act, 1976, or any applicable labour or criminal law;
- Requires participation in any immoral, fraudulent, hazardous, or exploitative activity.
Violation of this clause shall result in immediate account suspension, blacklisting, and reporting to regulatory or law enforcement authorities.
4. Subscription and Pricing
The Platform offers access through a subscription model. shall be as displayed on the Platform at the time of subscription and may vary based on services selected. Karmika reserves the right to modify pricing without prior notice.
All subscription fees are:
- Payable in advance;
- Non-refundable, except as expressly stated in a written agreement;
- Exclusive of any applicable taxes.
Access to core Platform features is enabled only with an active subscription.
5. Role of Karmika and Limitation of Liability
.Karmika is a technology platform acting solely as a facilitator between Work Providers and Work Seekers. We do not employ, contract, or represent any Work Seeker, nor do we participate in employment relationships or negotiations. While we perform basic document verification, we do not conduct background checks, police verification, or skill assessments.
You acknowledge and agree that:
- All hiring decisions, onboarding, and payment responsibilities rest solely with you;
- We shall not be liable for any misrepresentation, misconduct, theft, damage, negligence, or unlawful act by a Work Seeker;
- We are not obligated to offer refunds or replacements for workers who do not meet your requirements.
6. Statutory and Labor Law Compliance
As a Work Provider, you are solely responsible for ensuring full compliance with applicable Indian labor laws, including but not limited to:
- Minimum Wages Act, 1948
- Payment of Wages Act, 1936
- Employees’ Provident Funds and Miscellaneous Provisions Act, 1952
- Employees’ State Insurance Act, 1948
- Contract Labour (Regulation and Abolition) Act, 1970
- Any other applicable state or central legislation
You agree to:
- Pay all wages/salaries directly to the Work Seeker;
- Provide lawful working conditions and necessary facilities;
- Make timely contributions to EPF, ESIC, or other statutory welfare schemes as required;
- Maintain employment records and documentation;
- Ensure no worker is subjected to hazardous, exploitative, or inhumane working conditions.
Karmika disclaims all liability for any wage disputes, labor claims, or statutory non-compliance. You agree to indemnify the Company against any such liabilities.
7. Confidentiality and Data Use
You agree to maintain the confidentiality of all data accessed through the Platform and use it exclusively for lawful hiring purposes.
You shall not:
- Disclose or distribute any Work Seeker’s personal data to third parties;
- Use the Platform’s data for unauthorized marketing, profiling, or lead generation;
- Breach any applicable data protection regulations.
Violation of this clause will result in account suspension and may attract legal action.
8. Intellectual Property
All Platform content, designs, source code, and trademarks are the exclusive intellectual property of RASA MARCON PRIVATE LIMITED.
You shall not:
- Copy, reproduce, or distribute Platform content;
- Reverse engineer or attempt to access source code;
- Use Karmika’s branding or marks without prior written approval.
9. Indemnification
You agree to indemnify, defend, and hold harmless RASA MARCON PRIVATE LIMITED, its affiliates, directors, employees, and partners against any claims, losses, damages, penalties, or legal fees arising out of:
- Your use or misuse of the Platform;
- Your engagement with any Work Seeker;
- Violation of any labor or statutory law;
- Posting of unlawful or prohibited jobs.
10. Limitation of Liability
To the maximum extent permitted by law, Karmika shall not be liable for:
- Any indirect, incidental, or consequential damages;
- Business losses, missed profits, or reputational harm;
- Platform errors, downtime, or data loss;
- Any action, omission, or conduct of a Work Seeker.
Total liability, if any, shall be limited to the subscription amount paid by you in the 30 days prior to the event giving rise to the claim.
11. Termination
Karmika reserves the right to terminate your access to the Platform, with or without notice, in the event of:
- Breach of these Terms;
- Posting unlawful content or jobs;
- Misuse of data;
- Non-payment of subscription;
- Violation of statutory obligations.
No refund will be issued upon such termination.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or in connection with these Terms shall be subject to theexclusive jurisdiction of the courts in Pune, Maharashtra.
At Karmika’s discretion, disputes may be referred toarbitrationunder theArbitration and Conciliation Act, 1996, to be held in Pune in the English language before a sole arbitrator appointed by the Company.
- Agreement: These Terms represent the entire agreement and supersede all prior understandings.
- Severability: If any part is held invalid, the rest remains enforceable.
- >No Waiver: A waiver of one provision is not a waiver of others.
- Force Majeure: We are not liable for delays due to events beyond our control.
- Assignment: You may not assign rights under these Terms without written consent.
